New Rochelle doctor faces insurance fraud charges

A New York doctor was arraigned on insurance fraud charges for allegedly helping a former state corrections officer falsely claim injury and receive workers’ compensation benefits.

Michael Palmieri, 46, is charged with one count of third-degree grand larceny, a felony, and one count of fraudulent practice, a violation of state workers’ compensation law, according to the New York State Insurance Department.

The department alleges that between March 1, 2004, and April 8, 2006, Palmieri conspired with Leo Coletti, a former New York State corrections officer. Coletti pleaded guilty in 2006 to second-degree grand larceny and filing a false tax return, falsely claiming injury and receiving $40,170 from the New York State Insurance Fund.

In January 2002, Palmieri, an orthopedic surgery and sports medicine specialist with his office in New Rochelle, N.Y., prepared and presented false medical forms on Coletti’s behalf, the insurance department said. Coletti was a patient of the doctor’s beginning in September 29, 2002, for an injury received while working at Sing Sing Prison in June 2000.

The false medical forms, presented to the New York State Insurance Fund by Palmieri on Colletti’s behalf, falsely claimed the correctional officer was unable to perform work and was not working, according to insurance officials. Coletti was working at a general contracting and home renovation business in Westchester County, N.Y., and also doing renovations on Palmieri’s home, investigators discovered.

Palmieri is due in court on June 26 and faces a maximum of seven years in state prison if convicted on all counts.
