Jury acquits Gettysburg couple of felony charge of exaggerating claims
A Gettysburg, Pa.-area couple was acquitted of all felony charges by an Adams County Court, after being accused of collecting more than $10,000 by exaggerating claims from an act of vandalism.
The jury found Merry Miller, 26, and Thomas E. Varish, 48, both of Freedom Township, Pa., not guilty of several felony charges, according to the Hanover Evening Sun. Varish was found guilty on a pair of misdemeanors and is due for sentencing in August.
Varish was accused of filing a fraudulent claim with Erie Insurance in August 2006, claiming a rock had been thrown through the window of his home, according to court documents. He was paid $10,247 by Erie in March 2007.
Erie referred the claim to state investigators, who filed charges after finding a furniture quote from a local store appeared altered.
Charges were filed and Varish reimbursed Erie the entire amount of the claim in August 2007, according to the Evening Sun. The couple’s attorney claimed the pair did not intend to do anything criminal, and simply made a mistake, claiming mistakes were also made in restitution figures and insurance information from Erie, as well as the furniture store restitution.
