Niagara Falls man charged in alleged workers’ compensation scheme
A New York man was charged with insurance fraud and other felonies for allegedly collecting workers’ compensation benefits from the New York State Insurance Fund for a year after he returning to work.
William P. Franz Jr., 30, of Niagara Falls, N.Y., also was charged with offering a false instrument for filing, grand larceny, perjury and violating state workers’ compensation laws, according to the Niagara Gazette newspaper. He was arrested July 9.
He suffered a fractured foot while performing roofing work for a remodeling service in Depew, N.Y., in 2004, the newspaper said. After allegedly returning to work as a roofing subcontractor for a Cheektowaga, N.Y.-based general contracting firm, Franz collected more than $6,000 in lost wages, authorities said.
Franz’s injury led to his classification as permanent partially disabled, meaning he could have collected more than $300,000 in total lost wages over the life of his claim, the paper reported. He is accused of signing statements indicating he did not return to any form of work after his injury.
