Estate planning company, owner settle customer complaints case
An estate-planning company in Indiana and its owner, accused of failing to provide estate plans customers paid for, agreed to pay a $9,000 settlement.
Best Estate Planning LLC of Fort Wayne, Ind., and Daniel Pachuta, were charged with violating the state Deceptive Consumers Sales Act, according to the Fort Wayne Gazette newspaper.
The paper said a number of the company’s clients told authorities they never received the services they paid for, which was supposed to include as part of the estate plan a trust, a will, a living will and power of attorney.
Pachuta charged as much as $2,900 for the estate plans, which most clients learned about at free educational estate-planning seminars held at public libraries across Indiana starting in June 2008, the paper said.
Pachuta, who is not a lawyer nor employs any lawyers at his company, told customers they would receive documents that were legally binding, the paper said, citing court records.
