Former General Re executive sentenced in AIG fraud case

A former senior vice president with reinsurer General Re will spend two years on probation and pay a $10,000 fine after pleading guilty to manipulating American International Group’s financial statements.

gavelRichard Napier received the sentence in U.S. District Court Sept. 15 and his testimony helped convict four former General Re executives and a former AIG executive last year, according to Reuters.

In 2005, Napier pleaded guilty to conspiracy, saying he agreed to deals between the reinsurer and AIG allowing the latter to artificially inflate its profits.

Napier could have received five years in prison and a fine of up to $250,000.

Others linked to the fraudulent scheme have been sent to prison, including former AIG vice president Christian Milton, who received four years for his role.

In April, Elizabeth A. Monrad, General Re’s former chief financial officer, received a sentence of 18 months in prison and three months earlier, Ronald E. Ferguson, General Re’s CEO, was sentenced to two years in prison and must also pay a $200,000 fine.

Ferguson, Monrad, Milton and two other General Re employees, Robert D. Graham and Christopher P. Garand, engaged in the scheme to falsely inflate AIG’s reported loss reserves, a key indicator of financial health to insurance industry analysts and investors.

The fraud was carried out through the use of two sham reinsurance transactions between AIG subsidiaries and General Re in response to analysts’ criticism of a $59 million decrease in AIG’s loss reserves for the third quarter of 2000, according to prosecutors.

AIG subsequently restated $3.9 billion of earnings for the four-year period of 2000 to 2004 and agreed to a $1.64 billion regulatory settlement in 2006.
