Allianz Life wins federal suit alleging improper annuities marketing

A federal jury has ruled in favor of Minneapolis, Minn.-based Allianz Life Insurance Co. in a suit alleging the company is using unclear marketing materials to sell its annuities.

gavelFiled in the U.S. District Court District of Minnesota nearly four years ago, the case, Mooney v. Allianz Life Insurance Co., found the plaintiffs alleging the insurer fraudulently marketed certain annuity products as providing an “up-front” or “immediate” bonus, when the bonus was not fully available years after the products were purchased, according to the suit. The plaintiffs claimed the company was in violation of the Minnesota Prevention of Consumer Fraud Act for products purchased between Feb. 9, 2000, and May 10, 2007.

Linda Mooney, a 65-year-old retiree, filed the class-action suit after buying an equity-indexed annuity with the promise of an up-front 10% premium bonus of nearly $21,600, according to published reports. She contended that the company’s marketing materials, while a bit confusing, promised her the bonus.

The jury determined that while Allianz did use some misrepresentation in its sales practices, the plaintiffs in the case were not adversely affected. As a result, the jury awarded no damages to the plaintiffs.

“We are very pleased that the jury concluded that no harm came to our policyholders,” said Allianz Life President and CEO Gary C. Bhojwani added that the insurer remains “committed to doing the right thing for our customers” and “to guarding our reputation jealously.”

Allianz Life provides annuities, long-term care and life insurance products in the U.S. through a nationwide network of independent distribution. The company is part of Allianz Group, a global financial services group, employing nearly 155,000 people worldwide.
