Iowa insurance agent accused of stealing $100,000 in client funds

An Iowa insurance agent and securities broker was arrested after he allegedly took more than $100,000 from his clients for his own personal use.

James Harold Opheim, 54, of Spencer, Iowa, faces charges of first-degree theft and ongoing criminal conduct, both felonies, for allegedly diverting money from clients from between 2003 and 2009, according to the Spencer Daily Reporter.

Police said that Opheim, working out of his home, was taking money from clients, repaying it later from proceeds of other accounts and in between, using it for his personal use. His work drew the attention of the state’s insurance department, who revoked his license July 31, after becoming aware that he deposited a $30,000 check from one of his clients into his personal bank account rather than forwarding it to her insurer.

Five days later and after a warning by a bank employee, according to the insurance department, Opheim deposited a second check from the client made out to him for $30,000.

The department learned that Opheim’s bank had discovered other deposits in his personal account for checks made payable to ING, American Funds, American Equity, Northwestern Mutual and Allianz, according to the report.

In 2004, Opheim was the subject of another administrative action by the Iowa Insurance Division, resulting in a one-year, self-supervised license probationary period. He admitted to completing applications for at least 21 life insurance policies without meeting with clients or discussing the applications with the individuals to be insured, according to the Daily Reporter.

Opheim also allowed a third party to sign the applicants’ names to the applications, when that third party was unauthorized to do so, according to that report.
