Accenture is claiming patent infringement against a San Mateo, Calif.-based software company over its insurance products in a new federal lawsuit.

keyboardtype2In a complaint filed in federal district court in Wilmington, Del., Accenture seeks to halt the sale of Guidewire Software’s Insurance Suite and ClaimCenter products, indicating that they “have no substantial non-infringing use,” according to Reuters.

The suit also seeks damages for Accenture, a global management consulting, technology services and outsourcing company, according to the report.

A Guidewire executive told Reuters that Accenture’s suit stems from a patent that never should have been issued and that his firm did not infringe upon it. The company has asked the U.S. Patent Office to review the matter.

“Accenture is resorting to litigation to compete,” said Brian Desmond, vice president of marketing for Guidewire, told Reuters. “They have been left behind by the marketplace.”

In 2007, Accenture filed a complaint against Guidewire, alleging misappropriation of trade secrets. Guidewire subsequently countersued, with a judge dismissing both suits last year.
