North Dakota agent loses license over ‘unacceptable’ actions

North Dakota’s insurance department has revoked the license of an agent it says engaged in deceitful and dishonest practices against her clients.

Patricia Howard, 61, of Dunn Center, N.D., had her licensed revoked Dec. 29, barring her from selling, soliciting or negotiating insurance in the state.

The department found that between Sept. 19, 2008, and Oct. 15, 2009, Howard accepted money from several insurance clients and never forwarded the funds to insurance companies, according to a consent order issued by North Dakota Insurance Commissioner Adam Hamm and signed by Howard.

The consent order details two incidents involving Howard’s clients, including one where she accepted a check for $757 from a couple for a homeowner and liability policy, but kept the check rather than remitting it to the intended insurer.

Howard was also accused of creating a fake insurance binder document to make it appear as if the clients had coverage, when they did not.

“Ms. Howard’s actions were unacceptable and revoking her insurance license ensures that she will no longer be able to work with North Dakota’s insurance consumers,” Hamm said in a statement.

According to department records, Howard held life and annuity, variable life and annuity, casualty, accident and health and property licenses in the state, dating back to as early as 1994. She held appointments with eight insurers, state records indicated.

By signing the consent order, Howard waived her right to request and administrative hearing and accepted the penalty levied by the state.
