A New York podiatrist will pay more than $1 million to settle a federal lawsuit accusing him of submitting false claims to Medicare for reimbursement.

Stephen E. Ginsberg, who provided podiatric services out of offices in the Bronx and Queens, N.Y., has agreed to pay $1,014,953 in civil damages under the False Claims Act, according to the U.S. Attorney’s Office for the Southern District of New York.

On Dec. 11, 2008, Ginsberg pleaded guilty to several charges, including defrauding Medicare by submitting false and fraudulent claims for his services, officials said.

The federal government filed a civil suit against the doctor, claiming that from July 2003 through October 20008, Ginsburg violated the False Claims Act by falsely billing Medicare for services, including chemical cauterization procedures and nerve conduction studies, which were never actually performed.

Ginsberg also allegedly falsified medical records by falsely documenting that he performed certain services that were not rendered. The misrepresentations on documents netted Ginsberg reimbursements from Medicare in amounts that substantially exceeded the allowance, if any, for the services that were actually provided, according to authorities.
