N.Y. man found standing next to burning car accused of claims fraud

A Rochester, N.Y., man, found by emergency personnel standing near his burned car, is now accused of setting the fire in order to claim $1,200 in insurance money.

Timothy McNulty, 45, was arrested and charged with fourth-degree insurance fraud, according to the New York State Insurance Department.

McNulty is accused of filing a claim with Hanover Insurance for the loss of his car in December 2009 after police and firefighters found him standing near his burned 1997 Nissan Altima.

Investigators with the NYSID’s Frauds Bureau and the Monroe County Sheriff’s Office said McNulty suffered minor burns to his arms and gave authorities various accounts of what happened. A gas can was discovered by investigators in the back of the vehicle.

If convicted on the lone count of insurance fraud, McNulty could be sentenced to up to three years in prison.
