Court orders Texas regulators to remove State Farm info from website

A Texas judge has granted an injunction sought by State Farm forcing the state’s insurance regulatory agency to pull what the insurer calls “proprietary” information from its website.

Last month, State Farm filed an injunction in Travis County District Court against the Texas Department of Insurance (TDI), over information it provided regulators regarding a recent rate filing. The information, subsequently posted online for public viewing by the TDI, contained reinsurance information the insurer said “would be extremely valuable to our competitors” and not part of its original rate filing.

The Dallas Morning News reported that State District Judge Stephen Yelenosky agreed, issuing a temporary court order barring the TDI from posting the documents online. The judge did, however, present the possibility that if Texas Insurance Commissioner Mike Geeslin finds the rate filings are “insufficient” without the documents, he might change his mind, according to the report.

In March, Jerry Hagins, a spokesman for the TDI, said that while posting rate information online was “a new endeavor,” regulators were taking these steps to keep the public better informed on rate increases.

Kevin Davis, a spokesman for State Farm, told IFAwebnews.com the insurer appreciated the judge’s ruling and “we await the next steps.”

A spokesman for the Texas Department of Insurance deferred comment to IFAwebnews.com until regulators could review the court’s decision.
