N.D. insurance agent allegedly pockets premiums, accepts unlawful loan

A Bismarck, N.D., insurance agent and his agency were served a cease and desist order Dec. 15 for allegedly borrowing money from a client and misappropriating another client’s premium payments for personal use.

Brent Kitzan, through Kitzan & Associates, allegedly accepted premium payments from a client, but failed to pay the premium to the company. The client’s policy was cancelled as a result, although Kitzan allegedly continued to accept premium payments totaling more than $5,000.

Kitzan also allegedly borrowed about $48,000 from an insurance client, which is against state law.

The agent may request an administrative hearing within 30 days, after which North Dakota Insurance Commissioner Adam Hamm may make the cease and desist order permanent, meaning Kitzan and his company would be prohibited from conducting insurance business in the state.
