Voters in three states – Arizona, Colorado and Oklahoma – will determine in their Nov. 2 election if a key provision in the health reform law is implemented in their states.

A Florida judge called the wording of a Republican-backed constitutional amendment fighting the individual mandate in federal health reform “manifestly misleading” and removed it from the state’s November ballot.

The first court hearing over federal health reform began in Richmond, Va., July 1, where the Virginia Attorney General’s Office argued the law exceeds the limits on federal government described in the U.S. Constitution.

New Jersey Gov. Chris Christie is one of seven Republican governors who has not joined a 20-state suit challenging the constitutionality of the federal health reform law.

The first question I ask is this: Is the health insurance reform package that Congress and President Barack Obama passed constitutional?

Virginia Attorney General Ken Cuccinelli is urging Democrats in Washington, D.C., to reconsider the use of the “deem and pass” rule to approve health care reform and is threatening a state suit against any such comprehensive bill.

While 34 other states have considered or partially passed legislation to ban any federal mandate to secure health insurance coverage, the Virginia General Assembly has passed a bill that is expected to get the signature of the state’s governor.

As Congress debates a final comprehensive health care bill for the nation, one Virginia delegate is proposing that state residents, and possibly others nationwide, not be held to any coverage mandates.

The full Virginia Senate will now debate whether state residents will be held to possible federal mandates on health insurance after a series of bills passed the chamber’s commerce and labor committee.

Joining the chorus in other states, officials in both Idaho and Florida are staunchly protesting federal health insurance mandates for individuals and businesses.
